King Munhumutapa Claims Assassination Plot Amidst Power Struggle

0 0Harare, Zimbabwe (News of The South)– King Munhumutapa Timothy Chiminya has made startling allegations of a plot to assassinate him, claiming that state agents are unhappy with a recent court ruling that declared him the rightful King. King Munhumutapa stated he received information from within the system detailing a plan to eliminate him by shooting.
The crux of the alleged discontent stems from the King’s assertion that, following the high court declaration, chiefs, kraalheads, headmen, and the entire Chiefs council now fall under his authority. This development, he claims, has angered certain individuals within the Zimbabwean establishment.
King Munhumutapa emphasized the significance of the high court declaration, stating that it operates under international law and explicitly bars Daniel Garwe from dealing with chieftaincy matters. He further explained that this ruling establishes a separation of powers between the Ministry of Local Government and the King’s office.
Drawing on international law, King Munhumutapa argued that any continued installation of chiefs by Daniel Garwe would be a violation of these legal principles. He issued a strong warning, stating his intention to take legal action should such activities persist.
The monarch also cautioned about the broader implications for Zimbabwe if it continues to disregard international law. He suggested that such breaches could lead to repercussions for the country, including potential calls for judicial retraining due to a perceived lack of justice. King Munhumutapa stressed the importance of Zimbabweans respecting international legal frameworks.
International Law and Traditional Leadership:
The intersection of international law and traditional leadership is a complex and evolving area. While there isn’t a single, universally binding treaty specifically addressing the recognition and roles of traditional leaders, several international human rights instruments and principles are relevant.
These include:
Self-determination: This principle, enshrined in the UN Charter and various human rights covenants, recognizes the right of peoples to freely determine their political status and pursue their economic, social, and cultural development. This can be interpreted to include the right to maintain and develop their traditional institutions and governance structures, insofar as they are consistent with other human rights principles.
Cultural rights: International law protects the right of individuals to enjoy their culture (Article 27 of the Universal Declaration of Human Rights and Article 15 of the International Covenant on Economic, Social and Cultural Rights). Traditional leadership often plays a significant role in preserving and promoting cultural heritage.
Non-discrimination: International law prohibits discrimination based on various grounds, including social origin. This principle suggests that traditional leadership systems should not perpetuate discriminatory practices.
Rule of law and access to justice: While traditional justice systems can play a vital role in providing access to justice at the local level, they must operate within the framework of national and international human rights standards, ensuring fair processes and outcomes.
The extent to which international law directly dictates the recognition and powers of traditional leaders varies from country to country, often being mediated through national constitutions and legislation. However, the overarching principles of human rights, self-determination, and the rule of law provide a framework within which the role of traditional authorities is considered.
King Munhumutapa’s reliance on international law to support his claims highlights the growing awareness of these principles in matters of governance and traditional authority. The situation in Zimbabwe will likely continue to unfold as the King threatens legal action and the government potentially responds to these serious allegations. The international community may also observe how Zimbabwe navigates the intersection of its national laws and international legal obligations regarding traditional leadership and the rule of law.
