Harare, Zimbabwe. (News Of The South) – THE president of the Zimbabwe Development party Kisinoti Mukhwazhe has made an urgent aplication to the Constitutional court seeking for the dissolution of the cabinet and Parliament for gross economic incompetence and neglect of fundamental rights and freedom.

The Zimbabwean president is the respondent and the Voice of The People is the 2nd applicant.

News Of The South has a copy of the court document dated February 3 which reads:

1) This is an application seeking for the respondents to dissolve his cabinet and Parliament for gross economic incompetence and neglect of fundamental rights and freedom.
2)The storm is indeed brewing and it spells for disaster if Respondent does not act quickly to dissolve his cabinet and Parliament.
3) The mojority of the citizens have now been reduced to beggars because of gross incompetence by both the Respondents Cabinet and Parliament.
4)The application is urgent in that we are going to experience civil unrest and unless if the necessary urgent steps are not taken to rectify the situation.
5) The people have been taken too far and have been patient for some time now but they are growing impatient by the day and this is a recipe for disaster if not addressed quickly.
6)It is better to avoid the impending disaster as the old saying goes: ” It is better to prevent than cure”.
7) For these reasons I move that the matter be treated as urgent and heard as such.

The document further states that the application was made in terms of the supreme law of the land, the Constitution of Zimbabwe. The application is based on Chapter 8 section 167 (2d) which mentions that this Honourable Court may determine whether Parliament or the President has failed to fulfill a constitutional obligation.

The Constitution states that “…. all institutions and agencies of governmnet formulating and implementing laws and policy decisions that will lead to the establishment, enhancement and promotion of a sustainable, just, free and democratic society in which people enjoy prosperous, happy and fulfilling lives”.

Since this Honourable court is the highest in all constitutional matters, and its decisions on those matters hind all other courts, the Applicants have found it appropriate to file this suit before it.

According to Mukwazhe: “Zimbabwe is at defunct, both cabinet and Parliament denigrates the supremacy of the national law. People’s fundamental rights are violated. Nobody cares.

“The dissolution of both cabinet and Parliament will bring relief to the voiceless millions of zimbabwe.

“Zimbabweans are loyal to their Constitution,gvt flag and their liberation ideals but executors of executive authority are hostile to people and the constitution.

Mukwazhe went on to describe the ongoing demolition of houses occuring daily as “A reflection of total disregard of the the law on shelter rights and no equitable sharing of resources. We pray that the law will protect the people of Zimbabwe and their constitution. May also God remember Zimbabwe. God do not let Zimbabwe down”.
