ConCourt Ruling on Prof Moyo Denigrated
Harare, Zimbabwe (News of the South)-Former advisor to the then Prime Minister of Zimbabwe in the Government of National Unity (GNU) Dr Alex Magaisa has derided the recent ruling in the corruption case of Prof Jonathan Moyo which has been suspended indefinitely.
The Constitutional court on Wednesday slapped costs on Moyo but suspended the matter to an indefinite date after the Higher Education Minister, who is facing corruption charges of over $400 000, submitted papers that were not numbered.
The postponement came after the Prosecutor Thembinkosi Magwaliba raised a preliminary point arguing that the absence of numbers in Moyo’s papers made it difficult for him to follow.
However Dr Magaisa who is a lawyer by profession himself expressed dismay at the apparent exhibition of corrupt tendencies by those expected to pursue the matter.
“Unfortunately those who purport to be fighting it and are charged with enforcing laws are incorrigibly corrupt!”
In a veiled attack on Deputy Chief Justice Luke Malaba’s ruling Magaisa said the reason for the suspension was such as small matter it shouldn’t have been the basis for the indefinite postponement.
“Pagination itself is a clerical task. It’s putting numbers on pages. Not a good reason to not deal with a constitutionally important matter”.
“When some of us wrote that the Zimbabwe Anti-Corruption Commission (ZACC) was harming its case by mindless bungling, some here thought we were supporting Moyo. Now here we are”.
“ZACC had no business carrying out the arrest. This prompted this case & so long as its unresolved nothing will happen in the main matter”
“I think it (the case) collapsed a long time ago’.
“The appetite to pursue it was fuelled by factionalism and I suspect that it hit a brick wall within ZANU PF”, he said.
Prof Moyo’s lawyers apparently presented papers that were not numbered drawing the ire of Justice Luke Malaba who suspended the case on those grounds.
Dr Magaisa said the media had failed to read the situation correctly and had been sold a dummy in calling the ruling a loss by the Prof.
“Once again, the media has fallen for a dummy”.
“The fact of the matter is this case has been postponed indefinitely, which could mean forever!”
Moyo’s case has gone to the Constitutional court after he challenged the right of ZACC to arrest him. His co-accused and deputy Godfrey Gandawa has also since won a ruling allowing his case be heard at the Constitutional court.
